A Hard-Fought Win

After six years of litigation, my team delivered an important victory for one of the largest electronics and technology companies in the world.

During this marathon dispute, my team successfully defeated more than $45,000,000 in damages claims based on allegations of breach of contract, breach of warranty, fraud, and negligence. Not only did we defeat all of Plaintiffs’ claims, we secured a monetary settlement in favor of our client.

The case originated in October 2016 when Plaintiffs sought to use a lawsuit to justify their refusal to pay nearly $2,000,000 owed for the design, manufacturing, and installation of what was then one of the ten largest LED displays in the world. Over the ensuing years, our team methodically chipped away at Plaintiffs’ case using a combination of strategic motions practice and discovery to effectively limit Plaintiffs’ available damages while preserving our counterclaim for non-payment.

After three years, the team secured summary judgment in our favor on all of Plaintiffs’ claims for negligence and fraud.

Because of the pandemic, the trial did not occur as originally scheduled in June 2020. Instead, the case had multiple trial settings over the next two years. In the lead up to each, we watched as our co-defendants settled out. Because of the trust the client had in our team, we persisted. Plaintiffs continued their attempts over that two-year period to revive portions of their case. My team quickly responded to each attempt and added additional pressure by successfully winning key motions related to virtual witness appearances and Plaintiffs’ motion to continue trial into 2023.

Ultimately, the Court set trial for October 24, 2022. At our request, the Court held a final pretrial conference shortly ahead of jury selection. During the hearing, the Court ruled on substantive motions, siding with our client on all key issues and effectively dismissing one of the Plaintiffs’ cases.

Within hours of that ruling, Plaintiffs contacted our team to discuss settlement. Although Plaintiffs simultaneously moved the Court to reconsider its October 2022 rulings, our team responded to that motion in less than 24 hours and convinced the Court to affirm its holdings. Over the next two days, Plaintiffs offered various settlement options that would result in no money exchanging hands or a small payment to our client with a reservation of appellate rights.

Thanks to the trust the client placed in us to negotiate a favorable settlement, we were ultimately able to resolve the case with our client recovering a significant portion of the money owed under the LED sign contract, a full release of all claims and Plaintiffs’ abandonment of any appellate rights. At the conclusion of the case, opposing counsel expressed how impressed they were with our representation and the perseverance demonstrated to fight this case to the very end.
